Important notices
Please read these Terms carefully before buying, activating, installing, scanning, accessing, or using Platehaus MyQR.
MyQR is a convenience and contact-routing service. It is not an emergency response, police, medical, rescue, towing, clamping, security, parking-enforcement, roadside-assistance, insurance, workshop, JPJ, or dispatch service. If there is danger, crime, injury, fire, collision risk, attempted theft, harassment, public safety risk, or emergency, contact the relevant authority first.
If you enable direct phone call or WhatsApp contact, your phone number may be revealed to a Scanner and to the relevant third-party app or telecommunications provider. If you enable Telegram contact, the Telegram contact flow is designed not to reveal your phone number to the Scanner, but Telegram delivery is not guaranteed.
“Lifetime access” has the limited meaning stated in Clause 9. It does not mean perpetual access, the lifetime of any person or vehicle, or that all features will remain available forever.
These Terms contain disclaimers, liability limits, enforcement rights, indemnity obligations, and dispute provisions. Nothing in these Terms removes any right, remedy, warranty, guarantee, or protection that cannot lawfully be excluded under Malaysian law.
1. Agreement, scope, and acceptance
1.1 These Terms govern the purchase, activation, installation, access to, scanning of, and use of Platehaus MyQR. MyQR includes:
- physical QR windshield stickers, cards, labels, or other QR products supplied by Platehaus or its authorized sellers;
- one-time activation codes supplied with the QR product or by Platehaus;
- MyQRContact scan and car-owner contact flows;
- private vehicle dashboards and vehicle records;
- dashboard access roles, invitations, access requests, reports, reminders, uploads, and notifications;
- the Platehaus Telegram bot and other contact-method integrations; and
- related websites, mobile web pages, applications, APIs, emails, support services, software features, and backend systems.
1.2 These Terms apply to each person who interacts with MyQR, including purchasers, Owners, Authorized Users, Scanners, access requesters, invited users, fleet administrators, business customers, and support users. Some clauses apply only to particular roles.
1.3 By clicking an acceptance button, buying, activating, installing, scanning, contacting an Owner, requesting access, accepting an invitation, connecting Telegram, uploading Records, accessing a dashboard, or otherwise using MyQR, you agree to these Terms and the Platehaus MyQR Privacy Policy.
1.4 If you do not agree, do not buy, activate, install, scan, contact an Owner through, request access to, or use MyQR.
1.5 To improve enforceability, Platehaus may require separate confirmations for important actions, including activation, direct-phone/WhatsApp disclosure, Telegram setup, dashboard access approval, access requests, uploads, and reports. Platehaus may keep evidence of acceptance, including timestamp, version number, account ID, IP address, user agent, checkbox state, button event, and relevant consent logs.
1.6 You consent to receiving and providing notices, confirmations, disclosures, consents, and contractual communications electronically through email, website notice, dashboard notice, support messages, Telegram bot messages, or other reasonable electronic channels. You must keep your contact details current.
2. Relationship to other Platehaus terms
2.1 These Terms apply specifically to MyQR. Other Platehaus terms may apply to other Platehaus products, sales channels, marketplace services, refunds, promotions, business accounts, or general platform use.
2.2 If there is a conflict, the following order applies:
- mandatory Malaysian law and non-excludable consumer rights;
- a signed written agreement with Platehaus, but only for its specific subject matter;
- MyQR purchase, warranty, replacement, and refund terms for the physical QR product purchase;
- the Platehaus MyQR Privacy Policy for personal-data matters;
- these Terms for MyQR service use; and
- general Platehaus platform terms only where relevant and not inconsistent with these Terms.
2.3 If a court, tribunal, regulator, or applicable law treats any clause as invalid or unenforceable, the affected clause will be limited, modified, or severed to the minimum extent necessary. The rest of these Terms will continue to apply.
3. Definitions
“Platehaus”, “we”, “us”, or “our” means Platehaus Sdn. Bhd. only.
“Platehaus Parties” means Platehaus and its directors, officers, employees, affiliates, contractors, vendors, service providers, representatives, and agents.
“MyQR” or “Service” means the Platehaus QR sticker product and connected software service described in these Terms.
“Sticker” means the physical QR windshield sticker, card, label, or similar physical item supplied by Platehaus or its authorized sellers.
“Activation Code” means the one-time code that allows a number plate to be activated.
“Car Dashboard” or “Dashboard” means the private dashboard linked to an activated vehicle registration number.
“Owner” means the account that activates a number plate or is recorded by the Service as the active owner or administrator of a Dashboard.
“Authorized User” means a person given Dashboard access by an Owner, an editor, an invitation, an access approval, a fleet administrator, or Platehaus.
“Scanner” means a person who scans a Sticker or otherwise enters a vehicle registration number through MyQR to contact an Owner or driver.
“Contact Event” means a scan, plate lookup, reason selection, contact-method selection, Telegram alert, direct-contact redirect, report, access request, or related MyQR interaction.
“Records” means vehicle-related dashboard entries, including road tax, insurance, service, repairs, battery, tyres, brakes, air conditioning, accident, mileage, notes, documents, receipts, and attachments.
“Consumer” means a person who deals as a consumer under applicable Malaysian consumer law.
“Business Customer” means a person or entity using MyQR for business, fleet, employment, commercial, professional, association, property-management, parking, or organizational purposes.
4. What MyQR is
4.1 MyQR is intended to help:
- a person contact a vehicle owner, driver, or authorized vehicle contact about a vehicle-related issue; and
- an Owner keep useful vehicle Records in one Dashboard.
4.2 Examples of vehicle-related contact reasons include a vehicle blocking access, an alarm sounding, lights left on, possible towing or clamping, minor vehicle contact, a parking issue, a safety concern, or another legitimate vehicle-related issue.
4.3 MyQR is a communication, routing, recordkeeping, and notification tool only. It does not verify the truth of any scan reason, vehicle ownership, driver identity, authority, document, record, or upload unless Platehaus expressly confirms otherwise in writing.
5. What MyQR is not
5.1 MyQR is not:
- an emergency response service;
- a police, medical, rescue, towing, clamping, security, parking-enforcement, roadside-assistance, insurance, workshop, JPJ, compliance, inspection, or dispatch service;
- proof that a person legally owns, controls, drives, insures, maintains, or has authority over a vehicle;
- proof that any Scanner, Owner, Authorized User, requester, emergency contact, or Telegram user is who they claim to be;
- a guarantee that a message will be delivered, read, noticed, acted on, or acted on safely;
- a guarantee that a vehicle will avoid towing, clamping, fines, damage, theft, accident, injury, loss, or enforcement action;
- legal, insurance, mechanical, roadworthiness, maintenance, JPJ, compliance, or safety advice; or
- a substitute for contacting emergency services, police, building management, parking enforcement, an insurer, a workshop, or another appropriate authority.
5.2 If a situation involves danger, crime, threats, harassment, stalking, injury, fire, collision risk, attempted theft, public safety, or emergency, contact the appropriate authority first. Do not rely on MyQR as the only action.
6. Eligibility, accounts, and authority
6.1 You must be at least 18 years old and legally capable of entering a binding contract to buy, activate, manage, or administer a Sticker, Activation Code, Dashboard, or business/fleet account.
6.2 A person under 18 must not create an account, activate a Sticker, manage a Dashboard, approve access, or make purchases through MyQR. A person under 18 may use the public scan flow only with appropriate parent, guardian, school, employer, or responsible adult authority, or where reasonably necessary for a genuine vehicle-related safety or contact issue. To the extent the law limits contract formation by a minor, the rules in these Terms operate as conditions of permitted access.
6.3 You are responsible for:
- providing accurate account and contact information;
- keeping your login credentials secure;
- maintaining access to your email, phone, Telegram account, and devices;
- promptly updating incorrect or outdated information;
- ensuring every Authorized User has a legitimate reason to access the Dashboard;
- removing users who no longer require access;
- ensuring any emergency contact or third-party contact details you add are provided with proper authority and notice; and
- all actions taken through your account, unless caused by Platehaus’s proven breach of these Terms or applicable law.
6.4 We may refuse, suspend, restrict, or terminate access if we reasonably believe that an account, Sticker, Activation Code, number plate, contact flow, Telegram connection, uploaded content, Dashboard access, or pattern of use creates fraud, security, safety, abuse, legal, privacy, consumer, reputational, or operational risk.
7. Physical Sticker terms
7.1 Placement and installation
7.1.1 You are responsible for placing the Sticker safely and legally. You must not place a Sticker where it:
- blocks, reduces, or distracts the driver’s view;
- interferes with vehicle controls, sensors, cameras, mirrors, tint, wipers, defoggers, airbag deployment, or visibility;
- obscures, alters, covers, or interferes with the vehicle registration plate, road-tax display where applicable, inspection labels, toll/RFID devices, or safety markings;
- violates road, vehicle, tint, insurance, lease, hire-purchase, condominium, fleet, parking, workplace, inspection, workshop, or authority rules; or
- creates a safety hazard.
7.1.2 Platehaus does not guarantee that a Sticker is suitable for every windshield, vehicle surface, tint film, coating, climate condition, car-wash method, inspection rule, vehicle category, or authority requirement.
7.1.3 The Sticker is not a vehicle safety component, vehicle approval, regulatory label, JPJ endorsement, e-marking, or proof of compliance.
7.2 Physical product condition
7.2.1 The physical Sticker may be affected by normal wear, weathering, fading, adhesive failure, scratching, tampering, removal, QR damage, scanning difficulty, phone-camera limitations, lighting, network unavailability, browser limitations, and third-party app issues.
7.2.2 If a Sticker is defective on delivery, the applicable purchase, refund, replacement, or warranty policy will apply. A physical replacement does not create a second software entitlement unless Platehaus confirms otherwise.
7.2.3 You are responsible for testing scan visibility after installation and periodically after cleaning, tint replacement, accident repair, or windshield replacement.
7.3 Tampering and unauthorized placement
7.3.1 You must not copy, clone, resell, forge, scrape, obscure, vandalize, tamper with, redirect, spoof, or misuse a Sticker, QR code, Activation Code, or MyQR link.
7.3.2 You must not place a MyQR Sticker on a vehicle, object, location, or number plate that you are not authorized to use.
8. Activation Codes, number plates, disputes, and transfers
8.1 Each Activation Code is one-time use and may be activated only for a valid number plate format accepted by the Service.
8.2 By activating a Sticker, you represent that:
- you are the vehicle owner, primary driver, fleet operator, authorized family member, employee, agent, hirer, company representative, or another person with authority to connect the number plate to MyQR;
- the number plate you enter is accurate;
- you understand that Scanners and Authorized Users may rely on the entered number plate;
- you will promptly update or contact us about any material error, sale, transfer, loss of vehicle control, loss of authority, or dispute; and
- you will not activate a number plate to impersonate, harass, stalk, mislead, bait, scam, shame, threaten, monitor, or endanger another person.
8.3 Platehaus may decline activation, disable a Sticker, disable an Activation Code, suspend a Dashboard, restrict contact flows, transfer control, or require proof of authority if we reasonably believe there is a dispute, mistake, fraud, safety risk, privacy risk, consumer risk, or unauthorized activation.
8.4 Platehaus is not required to adjudicate legal vehicle ownership disputes. Where there is a credible dispute, we may freeze or disable the Dashboard and require the parties to resolve the matter through appropriate documents, platform procedures, or lawful channels.
8.5 Unless Platehaus provides a transfer tool or approves a support request, an Activation Code cannot be reused after activation and an activated number plate cannot be freely transferred to another unrelated vehicle or account.
8.6 If you sell, dispose of, return, scrap, or lose control of the vehicle, you must remove or disable the Sticker where practical and deactivate or transfer the Dashboard through the available product tools or support channel.
9. Lifetime access and product-line continuity
9.1 If any Platehaus page, packaging, promotion, checkout screen, or sales communication refers to “lifetime access”, that phrase has the meaning in this clause.
9.2 “Lifetime access” means access to MyQR software features for the lifetime of the MyQR service or product line, while Platehaus continues to operate that service and while your Sticker, account, number plate, and use remain in good standing under these Terms.
9.3 “Lifetime access” does not mean:
- the lifetime of any person;
- the lifetime of a vehicle;
- the lifetime of a number plate registration;
- the lifetime of a company, phone number, Telegram account, QR code, server, database, third-party vendor, app store, domain, or technology stack;
- perpetual, irrevocable, offline, unchanged, or guaranteed access;
- that every current feature, dashboard field, contact method, integration, notification method, Telegram bot, design, storage limit, URL, or record type will remain unchanged; or
- that the Service will continue if it becomes unlawful, unsafe, materially abused, commercially impracticable, technically infeasible, unsupported by vendors, affected by force majeure, or discontinued for legitimate business reasons.
9.4 If Platehaus decides to discontinue MyQR entirely, we will use reasonable efforts, where practicable, to give at least 60 days’ prior notice through the website, email, in-app notice, or another reasonable channel. During that notice period, where technically feasible and legally permitted, we will try to provide a reasonable way to export or retrieve key Dashboard Records.
9.5 We are not liable for loss of access caused by your breach, account loss, abuse, non-payment where applicable, third-party platform failure, legal requirement, security incident, emergency maintenance, vendor shutdown, force majeure, or discontinuation handled under this clause.
9.6 Nothing in this clause limits non-excludable statutory rights, consumer guarantees, or remedies that apply under Malaysian law.
10. Contact flow and safety
10.1 Contact reasons are not verified
Scanners may choose a contact reason. Platehaus does not verify that a selected reason is true, urgent, complete, safe, lawful, or made in good faith.
10.2 Owner safety duties
10.2.1 If you receive a MyQR alert, use your own judgment before responding, going to your vehicle, calling a number, opening a link, meeting anyone, paying money, providing documents, sharing personal information, or taking any physical action.
10.2.2 Do not go to an isolated location, meet an unknown person alone, send money, reveal sensitive information, or expose yourself to danger because of a MyQR alert. If the message suggests crime, threats, emergency, accident, towing, clamping, harassment, or risk to life or property, contact the appropriate authority first.
10.3 Scanner duties
If you scan a Sticker or contact an Owner, you must:
- use MyQR only for a legitimate vehicle-related reason;
- choose a truthful contact reason;
- use only the contact methods made available through the Service;
- not harass, threaten, stalk, shame, bait, scam, impersonate, extort, spam, or repeatedly contact the Owner;
- not use MyQR to lure anyone to an unsafe location;
- not use MyQR to collect personal data, identify patterns, track a driver, monitor a vehicle, or map activated plates;
- not create false reports or false urgency; and
- comply with all lawful instructions, warnings, rate limits, identity checks, and abuse-prevention controls.
10.4 Safety and abuse controls
10.4.1 To protect Owners, Scanners, Authorized Users, and the public, Platehaus may use product controls such as warnings, consent prompts, login requirements, rate limits, bot checks, Contact Event logs, report workflows, contact-method restrictions, Telegram confirmation steps, proof-of-authority requests, temporary contact pauses, suspicious-pattern review, account restrictions, and administrative enforcement.
10.4.2 These controls reduce risk but do not guarantee that misuse, false emergencies, harassment, stalking, scams, crime, notification failure, or unsafe physical responses will be detected or prevented. You must still use judgment and contact the appropriate authority when safety, crime, injury, property damage, towing, clamping, or emergency issues are involved.
11. Contact methods
11.1 Owners choose which contact methods to enable, subject to product requirements, safety controls, and availability.
11.2 If you enable phone call or WhatsApp, your phone number may be used to create a direct call link or WhatsApp redirect for a Scanner. This may reveal your phone number to the Scanner and to the relevant third-party app, telecommunications network, device, browser, or provider.
11.3 If you enable Telegram, the Service may send alerts through the Platehaus Telegram bot without revealing your phone number to the Scanner through the Telegram contact flow. Telegram delivery depends on Telegram, your Telegram account, your device, notification settings, network connectivity, the bot not being blocked or muted, and other factors outside Platehaus’s control.
11.4 We may require Telegram setup steps, test alerts, and confirmation buttons so that users understand notifications must remain enabled. Even then, we do not guarantee that Telegram alerts will always notify, sound, vibrate, appear, be read, or arrive on time.
11.5 If you add an emergency contact, alternate driver, fleet contact, family contact, employee contact, or other third-party contact, you represent that you have a lawful basis, authority, or consent to do so and that the person has been informed that their details may be used for MyQR contact and safety purposes.
11.6 We may add, remove, restrict, or change contact methods for safety, abuse prevention, legal compliance, third-party dependency, product, or operational reasons.
12. Dashboard Records and reminders
12.1 The Dashboard lets Owners and Authorized Users store vehicle-related Records. Records are for personal convenience and may not be complete, current, verified, official, or suitable for legal, insurance, resale, maintenance, safety, JPJ, warranty, or roadworthiness purposes.
12.2 You are responsible for:
- the accuracy of Records you enter;
- deciding what documents to upload;
- removing or redacting unnecessary personal, financial, sensitive, or third-party data;
- checking warranty, service, insurance, road tax, safety, and maintenance details with the official provider or a qualified professional;
- setting, checking, and acting on reminders; and
- ensuring Dashboard access is given only to appropriate people.
12.3 Platehaus does not verify Dashboard Records unless we expressly say otherwise in writing. A Record, reminder, attachment, dashboard label, or generated display does not certify that a vehicle is safe, legal, insured, maintained, roadworthy, or compliant.
13. Dashboard access, invitations, and requests
13.1 Owners and permitted Authorized Users may invite others or approve Dashboard access requests. Roles may include owner, editor, viewer, fleet administrator, or other product roles.
13.2 You are responsible for deciding who should have access and which role they should have. Depending on the product configuration, editors may be able to add, edit, remove, or invite access. Viewers may be able to see Records, attachments, Contact Events, approximate locations, reports, access lists, and related Dashboard data.
13.3 Do not invite someone unless they have a legitimate reason to access the Dashboard. Do not approve access requests unless you recognize the requester and understand what they will be able to see.
13.4 Platehaus may remove, restrict, suspend, or change access if needed for safety, abuse prevention, compliance, support, security, privacy, product operation, or dispute handling.
14. User content and uploads
14.1 You retain ownership of content you submit, including Dashboard Records, notes, receipts, photos, PDFs, reports, contact reasons, access requests, and support messages.
14.2 You give Platehaus a worldwide, non-exclusive, royalty-free license to host, store, copy, process, display, transmit, secure, back up, analyze, and use your content as needed to provide, protect, support, improve, enforce, or comply with legal obligations relating to the Service.
14.3 You must not upload or submit content that:
- is false, misleading, unlawful, defamatory, threatening, harassing, abusive, obscene, or invasive of privacy;
- infringes another person’s rights;
- contains malware, tracking code, hidden scripts, or unsafe file types;
- includes another person’s personal data without a proper reason and authority;
- includes unnecessary identity documents, payment credentials, passwords, medical data, biometric data, or other sensitive information;
- exposes a vehicle owner, driver, family member, child, employee, or third party to harassment, stalking, scams, or physical risk; or
- violates these Terms or applicable law.
14.4 We may scan, restrict, remove, refuse, preserve, or disclose content if reasonably required for security, moderation, legal compliance, service operation, dispute handling, abuse investigation, or safety.
15. Privacy and personal data
15.1 We process personal data under the Platehaus MyQR Privacy Policy, which is incorporated into these Terms.
15.2 By using MyQR, you acknowledge that the Service may process personal data including account data, number plates, phone numbers, Telegram identifiers, scan/contact metadata, IP address, user agent, approximate location, referrer, Dashboard Records, attachments, access requests, invitations, reports, support data, consent records, and audit records.
15.3 You must not submit another person’s personal data unless you have a lawful basis, authority, consent, or legitimate reason to do so.
15.4 If you are a Business Customer or you upload, disclose, or control other people’s personal data through MyQR, you are responsible for ensuring that your own collection, disclosure, use, access approval, and upload of that personal data complies with applicable law, employment obligations, fleet policies, customer notices, and required authorizations.
16. Prohibited use
16.1 You must not:
- use MyQR for stalking, harassment, surveillance, doxxing, blackmail, threats, scams, baiting, impersonation, unlawful debt collection, or criminal activity;
- repeatedly scan or contact a number plate without a legitimate vehicle-related reason;
- scrape, enumerate, bulk-query, automate, reverse engineer, bypass limits, or map activated plates;
- attempt to identify Owners, Scanners, Telegram users, Authorized Users, drivers, households, employees, or vehicle patterns beyond what the Service intentionally provides;
- interfere with the Service, API, dashboard, database, bot, security controls, rate limits, or access controls;
- upload malware, malicious scripts, credential harvesters, or harmful content;
- submit false reports, false contact reasons, false plate ownership claims, or false access requests;
- sell, rent, sublicense, or commercially exploit MyQR without authorization;
- use the Service for regulated emergency, towing, clamping, security, enforcement, insurance, investigation, employee-monitoring, private-investigation, or fleet-monitoring activity without our written agreement; or
- violate any applicable law, third-party terms, or rights.
16.2 You must not use MyQR in a way that causes Platehaus to breach law, third-party terms, platform rules, payment-provider rules, telecommunications rules, or data-protection obligations.
17. Reports, moderation, preservation, and enforcement
17.1 Owners and Authorized Users may report suspicious Contact Events. Platehaus may review account logs, Contact Events, reports, metadata, Dashboard access history, Telegram delivery data, uploaded content, and support communications to investigate abuse or enforce these Terms.
17.2 We may take reasonable enforcement actions, including:
- warning a user;
- disabling a contact method;
- disconnecting Telegram;
- requiring re-verification or proof of authority;
- restricting scans, contact events, Dashboard access, invitations, uploads, or account actions;
- removing content;
- disabling a Sticker, Activation Code, Dashboard, or account;
- preserving evidence;
- notifying affected users;
- cooperating with law enforcement, regulators, courts, insurers, building managers, parking operators, towing operators, or safety authorities where lawful and appropriate; and
- refusing support for unlawful or unsafe conduct.
17.3 We are not required to monitor every scan, message, Contact Event, Record, or user action.
17.4 You acknowledge that abuse logs, consent records, reports, support records, and security records may be preserved for legal, safety, security, evidence, dispute, or compliance reasons even after account closure or deletion requests, subject to the Privacy Policy and applicable law.
18. Third-party services
18.1 MyQR depends on third-party services such as hosting, database, storage, authentication, email, analytics, phone networks, WhatsApp, Telegram, browser vendors, device operating systems, QR scanners, device cameras, payment providers, logistics providers, and internet providers.
18.2 Third-party services are governed by their own terms and privacy policies. We do not control and are not responsible for third-party availability, delivery, notifications, policies, data handling, outages, security incidents, account restrictions, or feature changes, except to the extent applicable law says otherwise.
18.3 Your use of WhatsApp, Telegram, phone calls, email, browsers, app stores, payment services, maps, and telecommunications services may create separate legal and privacy relationships between you and those third parties.
19. Fees, purchases, refunds, replacements, and taxes
19.1 Prices, taxes, delivery fees, refund eligibility, replacement eligibility, warranty handling, and purchase disputes for the physical Sticker are governed by the purchase terms, checkout page, invoice, refund policy, or other sales terms shown or agreed at the time of purchase.
19.2 Unless expressly stated otherwise or required by law, buying a Sticker does not entitle you to a refund for:
- failure to install the Sticker correctly;
- entering the wrong number plate;
- losing access to your account, phone, Telegram, email, or vehicle;
- disabling contact methods;
- lack of scans or contacts;
- third-party notification failure;
- changes to features, designs, integrations, or limits; or
- service discontinuation handled under Clause 9.
19.3 You are responsible for any taxes, mobile data charges, SMS/call charges, WhatsApp/Telegram charges, bank charges, device costs, or third-party costs arising from your use.
19.4 Nothing in these Terms excludes refund, repair, replacement, damages, or other remedies that cannot be excluded under Malaysian law.
20. Service availability, changes, and beta features
20.1 We may modify, suspend, remove, replace, limit, or discontinue any feature, contact method, Dashboard field, record type, integration, storage limit, bot, URL, design, or software component for operational, legal, safety, security, commercial, vendor, product, or technical reasons.
20.2 Where a change materially affects active users, we will use reasonable efforts to provide notice through the website, email, in-app notice, or another reasonable channel, unless immediate action is needed for safety, security, legal, or operational reasons.
20.3 We will use reasonable efforts to keep the Service available, but we do not guarantee uninterrupted, error-free, secure, or real-time operation.
20.4 Some features may be experimental, beta, pilot, limited-release, or preview features. Such features may be changed, suspended, or removed with shorter notice, unless mandatory law requires otherwise.
21. Disclaimers
21.1 Nothing in these Terms excludes or limits any warranty, guarantee, right, or remedy that cannot be excluded or limited under applicable law.
21.2 To the maximum extent permitted by law, MyQR is provided “as is” and “as available”.
21.3 Platehaus disclaims warranties, representations, and guarantees not expressly stated in these Terms, including warranties of availability, accuracy, fitness for a particular purpose, merchantability, non-infringement, delivery of alerts, effectiveness of notifications, effectiveness of QR scanning, safety of in-person responses, and prevention of harassment, scams, crime, injury, loss, towing, clamping, fines, or vehicle damage.
21.4 We do not guarantee that:
- a Scanner’s reason is truthful;
- an Owner will respond;
- Telegram, WhatsApp, phone calls, email, or browser links will work;
- Contact Events will prevent towing, clamping, theft, accident, fines, damage, injury, harassment, scams, or loss;
- a Dashboard Record is accurate or complete;
- a reminder will be delivered or noticed;
- an uploaded document is valid or sufficient;
- a person using a plate, account, phone, or Telegram account is authorized; or
- the Service will detect or prevent misuse.
22. Limitation of liability
22.1 Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, wilful misconduct, gross negligence, death or personal injury caused by Platehaus’s proven negligence, non-excludable consumer guarantees, or any liability that cannot be excluded or limited under applicable law.
22.2 To the maximum extent permitted by law, Platehaus Parties will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or economic loss, including loss of profit, revenue, goodwill, data, opportunity, use, business, vehicle value, insurance position, or reputation.
22.3 To the maximum extent permitted by law, Platehaus Parties are not liable for harm, loss, claim, or damage arising from:
- harassment, stalking, threats, scams, baiting, impersonation, theft, assault, vandalism, accident, towing, clamping, fines, enforcement action, or criminal conduct by any user or third party;
- your decision to meet, call, message, pay, disclose information, approach a vehicle, or respond to an alert;
- inaccurate plate entry, incorrect activation, unauthorized activation, or transfer of vehicle ownership;
- Dashboard Records, reminders, attachments, access decisions, or uploaded documents;
- Telegram, WhatsApp, phone, email, network, device, browser, QR scanner, camera, or third-party failure;
- Sticker placement, visibility, adhesive performance, vehicle-surface damage, tint damage, or scanning difficulty;
- service suspension, restriction, modification, or discontinuation under these Terms; or
- unauthorized access caused by your failure to protect your account, device, email, phone, Telegram, or credentials.
22.4 To the maximum extent permitted by law, Platehaus’s total aggregate liability arising out of or relating to MyQR is limited to the greater of:
- the amount you paid Platehaus for the relevant Sticker
22.5 The cap in Clause 22.4 does not limit any refund, replacement, statutory remedy, consumer remedy, or liability that Malaysian law does not allow us to exclude or limit.
22.6 For Business Customers, the liability limits and disclaimers apply to the maximum extent permitted by law. For Consumers, each limitation applies only to the extent it is fair, reasonable, clearly brought to the Consumer’s attention, and permitted under Malaysian law.
23. Indemnity
23.1 To the maximum extent permitted by law, you agree to indemnify and hold harmless Platehaus Parties from claims, losses, damages, liabilities, penalties, fines, costs, and reasonable legal fees arising from or relating to:
- your breach of these Terms;
- your misuse of a Sticker, Activation Code, Dashboard, contact flow, Telegram bot, Records, invitations, access requests, reports, or uploads;
- your unlawful, unsafe, abusive, misleading, harassing, stalking, scam, baiting, or criminal conduct;
- your incorrect or unauthorized activation of a number plate;
- your decision to share phone numbers, Telegram details, Records, documents, emergency contact details, or access with others;
- content or personal data you submit;
- your violation of third-party rights or laws; or
- any claim by an Owner, Scanner, Authorized User, vehicle owner, driver, family member, passenger, third party, authority, insurer, building manager, parking operator, towing operator, or enforcement body arising from your act, omission, breach, content, or misuse.
23.2 This indemnity applies only to the extent the claim is caused by your act, omission, breach, content, or misuse. It does not require you to indemnify Platehaus for Platehaus’s own fraud, wilful misconduct, gross negligence, or liability that cannot lawfully be shifted to you.
23.3 For Consumers, this indemnity applies only to the extent permitted by Malaysian law and only where it is fair and proportionate to your responsibility for the claim.
24. Termination, deactivation, deletion, and export
24.1 You may stop using MyQR at any time. You may request deletion, export, transfer, or deactivation through available product tools or support, subject to identity verification, technical feasibility, legal requirements, fraud prevention, safety, retention rules, and third-party limitations.
24.2 We may suspend or terminate your access immediately if we reasonably believe you breached these Terms, created risk, misused the Service, violated law, or compromised safety, security, privacy, or trust.
24.3 Termination does not automatically delete Records, logs, reports, Contact Events, invoices, support records, or evidence that we need to retain for legal, security, abuse-prevention, dispute, tax, accounting, or operational reasons.
24.4 Where technically feasible and legally permitted, we may provide export tools or support-assisted export for key Dashboard Records. We are not required to provide export of system logs, security records, privileged support notes, proprietary metadata, or data relating to other users where disclosure would affect privacy, confidentiality, safety, or legal rights.
25. Changes to these Terms
25.1 We may update these Terms from time to time.
25.2 If a change materially affects your rights or obligations, we will use reasonable efforts to notify you by website notice, email, in-app notice, consent prompt, or another reasonable method.
25.3 If you continue using the Service after the updated Terms take effect, you accept the updated Terms. Where required by law or product design, we may ask for fresh consent.
25.4 We may require re-acceptance for changes involving direct contact disclosure, paid services, data practices, liability terms, lifetime-access interpretation, or material safety rules.
26. Notices and electronic communications
26.1 We may contact you through email, dashboard notices, website notices, support messages, Telegram bot messages, or other reasonable electronic channels.
26.2 You are responsible for ensuring that email, Telegram, phone, browser, and device notification settings allow you to receive important MyQR communications.
26.3 A notice sent to the latest contact details in your account will be treated as received unless mandatory law requires another rule.
27. Assignment and business changes
27.1 You may not assign, transfer, or delegate your rights or obligations under these Terms without Platehaus’s written approval, except through product tools that we make available.
27.2 Platehaus may assign or transfer these Terms, the Service, or relevant rights and obligations to an affiliate, successor, acquirer, purchaser, or operator of the MyQR business, subject to applicable law and appropriate continuity protections for Consumers and personal data.
28. Severability, waiver, entire agreement, and survival
28.1 If any part of these Terms is found invalid or unenforceable, the remainder will continue to apply.
28.2 Our failure to enforce a clause is not a waiver of our right to enforce it later.
28.3 These Terms, the Privacy Policy, and applicable purchase terms form the agreement between you and Platehaus for MyQR.
28.4 Clauses intended to survive termination will survive, including clauses on ownership, user content license, privacy, records, reports, enforcement, disclaimers, liability limits, indemnity, dispute resolution, governing law, and retention.
29. Governing law and disputes
29.1 These Terms are governed by the laws of Malaysia.
29.2 Before filing a claim, you agree to contact support@platehaus.my and allow us a reasonable opportunity to investigate and respond, unless urgent legal relief is needed.
29.3 Subject to non-excludable consumer rights, disputes are subject to the courts of Malaysia. Nothing in these Terms prevents a Consumer from using the Tribunal for Consumer Claims or another forum where Malaysian law gives a non-waivable right to do so.
29.4 Nothing in these Terms prevents Platehaus from seeking urgent injunctive, protective, preservation, or equitable relief for abuse, security incidents, intellectual property misuse, data misuse, unauthorized access, or safety risks.
