By checking out, you agree to these Buyer Terms, our Terms of Use, and Privacy Policy (PDPA). All payments run through secure platform payment via DuitNow & RENTAS; we do not offer regulated remittance or custodial services of any kind.


1. INTERPRETATION & PRECEDENCE

1.1 Interpretation

References to laws include amendments and re-enactments; including means including without limitation; headings are for convenience only; singular includes plural and vice versa. Business Day (BD) means a day banks are open in Kuala Lumpur. Cut-off for BD calculations: 6:00pm MYT.

1.2 Order of Precedence (Refund/Dispute SoT)

If there is any inconsistency relating to refunds, cancellations, complaints, evidence, chargebacks/recalls, AML holds, under/over-payments, or refund timing/methods, the Refund & Dispute Policy (Malaysia) prevails over these Buyer Terms for those topics. Otherwise, these Buyer Terms control, and the stack-wide precedence in the Terms of Use applies.

1.3 Versioning & Prospectivity

This document displays a version and Last Updated date. Your agreement is recorded against the version in force at checkout. Updates apply prospectively to orders placed after the effective date unless required by law.

1.4 Definitions

  • Platform: platehaus.my and related services operated by Platehaus Sdn. Bhd.
  • Listing: a number plate offered for sale on the Platform.
  • Seller: the person or company offering the plate on the Platform.
  • Buyer / you: the purchasing customer.
  • PFI (Proforma Invoice): the order summary generated at checkout that states the Order Particulars.
  • Order Particulars: the plate, price and any other details shown in the PFI at checkout.
  • Completion Event (CE): dual confirmation by Buyer and Seller recorded in the Platform that JPJ transfer/assignment is completed, supported by transfer documentation uploaded via the fulfilment flow (examples in the Annex). Platehaus may perform reasonableness checks; unless flagged or in dispute, Platehaus does not independently verify authenticity at CE.
  • JPJ: Jabatan Pengangkutan Jalan Malaysia.

1.5 Electronic Records & Signature; Evidential Logs

You agree that click-acceptance, in-app actions, and electronic signatures are legally binding. You consent to Platehaus maintaining event logs (e.g., user id, timestamps, device, IP, user agent), which may be used as admissible evidence of acceptance, notices, and CE/fulfilment steps.


2. SCOPE, MOR POSTURE & LISTING TYPES

We support all plate types/series/genres, whether registered or unregistered, except any that are illegal/forbidden (not permitted on the Platform).

MoR & Directed Delivery. Platehaus is seller-of-record to you and instructs the Seller to deliver/assign directly to you via JPJ. If delivery/assignment fails due to Seller breach, Platehaus will refund you under the Refund & Dispute Policy.

Verification timing. We do not verify a Seller’s ownership/eligibility before an order is created. Verification occurs during order processing before acceptance. If verification fails, the order is not accepted; a full refund is made (see Refund & Dispute Policy (Malaysia)).


3. WHEN YOUR ORDER IS BINDING

Your order becomes binding at checkout when you confirm and the PFI is issued on-screen. Any later email/acknowledgement is informational only.


4. PAYMENT WINDOW, RAILS & CURRENCY

4.1 Payment Initiation Deadline. Payment must be initiated within 15 minutes of checkout. This deadline ensures that Order Particulars (including price) do not change during the payment window provided to you by Platehaus. Within this 15-minute window, the listing price will not change. If payment is initiated outside the 15-minute window, the price may change; if such a change occurs, Platehaus will issue a full refund and cancel the order.

4.2 Permitted Rails (MYR-only). As designated at checkout: DuitNow Transfer/QR (≤ RM50,000) and RENTAS (≥ RM50,001). Payments must come from the Buyer's own account; third-party payments are refunded to source as set out in Clause 12.3 and the Refund & Dispute Policy (Malaysia). Detailed matching rules and third-party payor handling are governed by the Refund & Dispute Policy (Malaysia).


5. ORDER PROCESSING (SECURE PLATFORM PAYMENT VIA DUITNOW & RENTAS)

Upon payment, order verification is initiated in our fulfilment process (which includes Seller acceptance recorded on the Platform, which must occur within 48 hours per the applicable Seller Agreement, i.e., the Dealer Sales Agreement or Private Owner Sales Agreement, as relevant).

If there is no verification/acceptance within 48 hours and you request a refund, Platehaus will process a refund to the original payment rail in line with the Refund & Dispute Policy (Malaysia) (including any risk/AML reviews).

References in these Terms to verification, sequencing, or operational processing are purely operational and do not create any fiduciary, custodial, or remittance arrangement; they remain covered by secure platform payment via DuitNow & RENTAS only.


6. BUYER RESPONSIBILITIES & COMMUNICATIONS

6.1 Cooperation. You must cooperate with the Seller and JPJ to complete the transfer/assignment, including timely provision of documents and attendance (in-person or digital) as scheduled.

6.2 Where your documents go. Provide required documents through the Platform or directly to the Seller (the designated fulfilment contact) for JPJ use only. Platehaus may request copies from the Seller for review, audit or inquiry.

6.3 Response duty. We expect responses within 24 hours as a soft SLA. If you fail to respond within 3 calendar days to proceed, or if the Seller files a dispute and is within their right (i.e., Seller not in breach), the order may be cancelled and a refund processed less the Buyer penalty in Clause 12.5.

6.4 Fulfilment Schedule Agreement. You must come to an agreement with the Seller on the order fulfilment schedule and timing via Platform chat or WhatsApp. The schedule agreed between you and the Seller is the operative schedule for the Order. There is no default platform-imposed deadline; you and the Seller determine what works for your circumstances. Schedules may be short-term (days) or extended (weeks/months) depending on your circumstances (e.g., waiting for vehicle delivery, using a holding vehicle). You are responsible for cooperating with the Seller to establish and meet the agreed schedule.

6.5 Rescheduling. Rescheduling is a Buyer–Seller arrangement via Platform chat or WhatsApp. Either party may propose changes; changes require mutual agreement. The Buyer bears any cost or consequences of rescheduling; the Seller bears none.

6.6 Official channels. (a) Platform chat is the preferred channel for all Order-related communications including scheduling, rescheduling, and confirmations. (b) WhatsApp and other messengers are accepted for scheduling, rescheduling, and fulfilment coordination. (c) In the event of a dispute involving WhatsApp or messenger communications, both parties must agree that the submitted evidence is factual. If either party disputes the authenticity or accuracy of the evidence, Platehaus will escalate and investigate before making any determination.

6.7 Eligibility. You must be 18+ and hold a valid driver's licence.

6.8 Holding Vehicles. Transfer may be to your primary vehicle or a holding vehicle (e.g., motorcycle); Completion Event (CE) is valid regardless of vehicle type. Subsequent transfers by you to other vehicles are outside this Order.

6.9 Verification Obligation at JPJ Transfer. You are obliged to verify at the JPJ office during registration transfer (handover) that the number plate's prefix, number, and suffix match exactly the details shown in the Listing at checkout. Failure to verify before or at the time of JPJ transfer registration constitutes a breach of contract and may result in no refund as set out in Clause 12.6. You must check the plate details with JPJ before confirming Completion Event (CE) in the Platform.


7. COMPLETION EVENT & RECORDS

7.1 Completion Event. Requires dual confirmation by Buyer and Seller recorded in the Platform and transfer documentation uploaded via the fulfilment flow (examples in the Annex). Platehaus does not independently verify unless flagged or a dispute is raised.

7.2 Records. The Completion Event is recorded for transaction records and dispute timelines.


8. COMPLAINTS WINDOW (POST-HANDOVER)

You have 1 day from the scheduled handover to lodge a complaint in-app (attach evidence). Late complaints may still be reviewed at Platehaus's discretion where reasonable. Note: After Completion Event (CE) is recorded and transfer is complete, refund rights are limited as set out in Clause 12.6. You must verify plate details at JPJ office during transfer as required under Clause 6.8. Evidence requirements and processing follow the Refund & Dispute Policy (Malaysia).


9. UNDER/OVER-PAYMENTS

Over- and under-payment handling follows the Refund & Dispute Policy (Malaysia).


10. CHARGEBACKS & RECALLS

Handling of bank recalls/claims (non-card rails) follows the Refund & Dispute Policy (Malaysia). Unwarranted recalls or abusive complaints may lead to account restrictions.


11. RISK, COMPLIANCE & AML

We may pause, refuse, or refund payments where fraud, sanctions, policy breaches, third-party payors, or other risks are suspected. Investigation windows and document requests follow the Refund & Dispute Policy (Malaysia).


12. REFUNDS — WHEN YOU GET YOUR MONEY BACK

12.1 Seller cannot proceed (no Buyer breach). Full refund, less documented unrecoverable third-party costs (e.g., JPJ payments already made, government levies, bank recall fees). Refund is to the original payment rail.

12.2 Payment window change. If your payment is initiated outside the 15-minute window (see Clause 4.1) and the price/Order Particulars changed, Platehaus issues a full refund to the original rail.

12.3 Third-party payors. If payment came from a non-Buyer account, we refund to the source account after a 1–3 Business Days review (see Refund & Dispute Policy (Malaysia) §2.3). No exceptions.

12.4 Timing & method. Refund initiation SLAs and method are governed by the Refund & Dispute Policy (Malaysia).

12.5 Buyer penalty (change of mind or Buyer-fault).

  • Buyer change of mind: No refund. If the Seller agrees to cancel, Platehaus may permit a discretionary refund less a penalty equal to 5% of the purchase price, minimum RM500, maximum RM5,000. This amount is a genuine pre-estimate of administrative, coordination and opportunity costs, and does not apply where the Seller is in breach. The penalty amount (net of bank or investigation costs) is paid to the Seller to compensate for lost administrative, coordination and opportunity costs.

  • Buyer non-response/refusal: If you fail to respond within 3 calendar days to proceed, or refuse to complete at handover without Seller breach, the order may be cancelled and refunded less the same penalty above. The penalty amount (net of bank or investigation costs) is paid to the Seller to compensate for lost administrative, coordination and opportunity costs.

12.6 Transaction Finality & Limited Refund Rights After Transfer.

All transactions are final once the number plate is transferred to your name at the JPJ office and Completion Event (CE) is recorded in the Platform. There may be no refund after transfer unless:

(a) there is provable fraud by the Seller (e.g., forged documents, fraudulent misrepresentation of ownership);
(b) there is intentional deceiving by the Seller (e.g., knowingly misrepresenting plate details, concealing encumbrances, deliberate misrepresentation); or
(c) the Seller has materially breached their warranties under the applicable Seller Agreement and such breach is proven.

Failure to verify the plate details (prefix, number, suffix) at JPJ office during transfer as required under Clause 6.8 constitutes a Buyer breach and may result in no refund, even if discrepancies are discovered after transfer.

Evidence Requirements: For refunds after transfer, you must provide clear evidence of fraud, intentional deceiving, or material breach (e.g., JPJ records, official documentation, Platform records). Refund eligibility and processing follow the Refund & Dispute Policy (Malaysia).


13. PRIVACY & RETENTION

Your data is handled per our Terms of Use and Privacy Policy (PDPA) (incorporated by reference). We may share necessary data with the Seller, JPJ, payment providers, and authorized agents solely to fulfil your order. Retention: transaction records (payments, orders, particulars) are kept for 7 years or as otherwise required by law.


14. PLATFORM LIMITATIONS, MOR ASSURANCE & NO ADVICE

The JPJ transfer/assignment is completed through the official JPJ process. You will deal and cooperate directly with the Seller for JPJ steps, scheduling, and document exchanges. Platehaus and the Seller do not provide financial, legal, or procedural advice (including JPJ advice). Timelines may be impacted by bank cut-offs, public holidays, or JPJ scheduling. As Merchant of Record, Platehaus is responsible for coordinating delivery/assignment or refunding you per this Policy if Seller fails.


15. LIABILITY & INDEMNITY

15.1 Cap. To the fullest extent permitted by law, Platehaus’ total liability to you for any transaction is capped at the Purchase Price you paid for that transaction.

15.2 Exclusions. We exclude indirect, consequential, loss of profit/opportunity damages, except where prohibited by law.

15.3 Your indemnity. You indemnify and hold harmless Platehaus and the Seller from losses arising from your misconduct, breach of these Terms, or breach of law, including submission of unlawful or misleading information, to the extent permitted by law.

15.4 Survival. Payment obligations, refund obligations, indemnity, liability limitations, dispute resolution, and confidentiality/data provisions survive termination or expiry of your relationship with Platehaus for 6 years or as otherwise required by law.


16. LAW, FORUM & PUBLIC REDRESS

These Terms are governed by the laws of Malaysia. Dispute Path: Before any proceedings, the parties will participate in Internal Review (14 days) through Platehaus internal audit & review, followed by non-binding internal mediation (within 30 days). If unresolved, disputes are subject to the exclusive jurisdiction of the courts of Kuala Lumpur/Selangor, without prejudice to your right to bring a claim before the Tribunal for Consumer Claims (TCC) where applicable. Either party may seek interim or injunctive relief at any time. Your non-waivable statutory rights remain unaffected.


17. CHANGES & VERSIONING

This page displays the document version and last updated date. By checking out, you agree to the current version of these Buyer Terms.


18. INVOICES

Retail invoice is issued by Platehaus to the Buyer. The Seller issues a supplier invoice to Platehaus.


19. PROHIBITED CONDUCT (EXAMPLES)

Fraud; forged or misleading documents; harassment or abuse; use of third-party payors; collusion to manipulate prices or availability; abusive bank recall claims; or any conduct that harms other users or the Platform. Violations may result in order cancellation, account restriction/suspension, and recovery of losses.


20. Invite-SA Discount Program

If you invite your Sales Partner (SA) to register as an affiliate using your referral code, you may be eligible for 5% off the plate price (cap RM3,000) on your first purchase only. Eligibility requires the invite relationship to be recorded on the Platform and may be revoked for fraud, misuse, or ineligible activity. The discount is applied automatically at checkout if eligible, is non-transferable, not stackable with other promotions unless expressly stated, and may be modified or withdrawn at any time.


21. Seller Referral Commission Program

If you refer a seller via your referral code and that referred seller completes a sale, you may earn 2% of the plate price as a referral commission. The referred seller must not be a dealer (role "seller"), and eligibility requires the referral to be recorded on the Platform. The commission is funded first from the Platform fee and then from any affiliate commission if needed. There is no limit on the number of eligible sales. This program may be modified or withdrawn at any time.


Annex A — Examples of Completion Evidence (Non-exhaustive)

  • JPJ transfer/assignment receipt or official confirmation
  • Ownership/VOC update evidence
  • MyJPJ/MySIKAP assignment confirmation/screenshot
  • Any other documents reasonably requested if a dispute/risk flag arises
